Title:	網路交易課徵所得稅之研究

Abstract:	由於網路交易克服了傳統交易中對於時間、空間的障礙，資訊的快速傳輸再加上網路的匿名性，使得網路交易的稅捐徵收比傳統商務交易更為複雜，現行的租稅法規仍無法對網路交易的發展進行有效的因應。因此，在稅務行政上產生了重大的影響，例如：網路使用者身份不易確認、課稅證據不易掌握、傳統中介者的消逝、跨境網路交易的國際租稅問題、課稅權的歸屬問題以及租稅領域之間的惡性競爭等。雖然財政部已於94年5月5日訂定「網路交易課徵營業稅及所得稅規範」，惟隨著網路科技快速蓬勃發展，網路交易已朝向跨境銷售、小額交易、行動下單、線上交付、線上付款等型態演進，衍生新型態之虛擬世界法規關係。因此，為了因應虛擬世界發展之挑戰，鑑於我國現行對網路交易所得課稅之相關法令，已不足以符合此一發展趨勢要求，有配合近期國際趨勢進行檢討修正之必要。
