    Title: 從國際人權法與禁止奴役論非本籍漁工處境及其救濟
    Prohibition of Slavery under International Human Rights Norms as a Remedy to Alien Fishing Workers$ Situations

    Abstract: 禁止奴隸制及販奴為絕對法,古典意涵下的奴隸制並為全球國家所廢止。然而,全球化與人員流動下,當代形式的奴隸制成為國際組織關切重心。既有之奴役與強制勞動法律概念,或可涵蓋「類似奴隸」之處境,但國際人權法相關定義似乎趨向概念的稀釋與模糊,反令司法實務上之「使人為奴罪」難以操作。歐洲人權法院近10 年奠定之解釋,或許有助於建立類似禁止酷刑條款之層級化、類型化保障。我國憲法保障人身自由與人性尊嚴,並於法律層面禁止使人為奴或以不等價之待遇交換勞務,宜納入國際人權法之奴役與強制勞動概念加以協和解釋。本研究同時以移工中處境至為邊緣之非本籍漁工為研究標的,尤其針對不適用我國勞動法規保障之境外聘僱漁工。以經濟社會權利看待或為根本之道,然涉及之諸多利益難以妥協,亦構成障礙。漁工之工作性質與生活條件,使渠等擔負更高之移動風險,離港時欠缺即時有效救濟,端賴進港時予以補救。我國應更新相關刑罰之解釋,落實禁止奴役,在程序面上克盡國家積極義務。
    Prohibition of slavery and slave trade is considered as jus cogens, while slavery, in its classical sens, has been abolished by all States in the world. However, globalisation and service mobility draws increasingly concerns about contemporary forms of slavery in international organisations. The existing legal concepts of servitude and forced labour may cover situations of “slave-alike”, but there is also a trend of concept delusion and confusion under the competing interpretation of international human rights norms, which makes application of “crime of enslavement” more difficult to be operational. A number of analysis of the European Court of Human Rights in the past ten years seem useful in establishing a categorical protection, similar to what has been constructed under the prohibition of torture clause. The right to liberty of person and human dignity enshrine in our constitutional law, and the criminal law also punishes crime of enslavement. It is time for Taiwan to incorporate concept of modern servitude into domestic law via in concordance interpretation. This research project chooses alien fishing workers as case study, for their situations are among the most peripheral and marginalised. The working conditions can be at high risk when they are recruited in foreign ports and territories and thus kept from being beneficiary to the Taiwanese labour protection standards. Approaching the problematic through economic and social rights may seem essential and indispensable, but it would therefore need a long run reconciliation between the social forces of different interests. Besides, fishing workers’ conditions of working and living put them high on the risk of mobility: they spend most of the time on board and rarely land themselves. Taiwan needs to prohibit efficiently enslavement as a posteriori remedy to their violated rights, for instance effective investigation, punishment and compensation. This also constitutes an important part of Taiwan’s positive obligations under the absolute prohibition of slavery.
