    Abstract: 本文借探討軍職和公務員在違失行為懲戒上的差異，並通過案例分析來檢視懲戒制度的實施效果。基於軍隊任務的特殊性，懲罰公平性對部隊重要性更為重要。研究方法包括文獻分析法和比較研究法，主要針對軍人違失行為的類型、懲罰及救濟方式進行探討。論文分為六章，涵蓋緒論、文獻探討、軍人違失行為類型、懲罰與救濟、文武職差異比較，研究結果顯示，軍人和公務員在懲戒制度上存在落差，並提出了改進建議以提升懲罰制度的公平性和有效性。
    This thesis explores the differences in disciplinary sanctions and punishment between military personnel and civil servants. And examines the effectiveness of the disciplinary system through case analysis. Given the unique nature of military tasks, the fairness of punishment is of greater importance to the troops. The research methods include literature analysis and comparative research, focusing on the types of misconduct, punishments, and remedies for military personnel. The thesis is divided into six chapters, covering the introduction, literature review, types of military misconduct, punishments and remedies, comparison of military and civil service, and the research results show that there is a gap in the disciplinary system between military personnel and civil servants. The thesis also proposes recommendations to improve the fairness and effectiveness of the punishment system.
