    Title: 我國實施週休三日可行性研究
    A Study on the Feasibility of Implementing Four-Day Workweek in Taiwan

    Abstract: 週休三日的議題近年引起國人廣泛討論,然而該制度是否適合在國內實施,尚無相關研究,因此本文旨在探究臺灣實施週休三日的可行性,依據「經濟可行性」、「法律可行性」及「政策可行性」三大構面進行討論,本研究先依文獻分析法,蒐集各國週休三日之試驗結果、影響及各國工時制度現況,最後再以質性研究方式,訪談國內各方代表,以作本文結論與建議,以下分別說明:
    一、 結論
    從經濟可行性角度分析,雖然國際試驗成果十分正面,但受訪者普遍擔憂周休三日造成公司經營問題,如加劇人力短缺、成本上升,因此在此構面下,有較多阻礙;「法律可行性」構面來看,國內勞動基準法,已可實現週休三日,只要不違背勞工意願,勞資雙方合意,並無違法問題,也就是在現行法律框架之下,週休三日完全可行;「政策可行性」構面涉及政府修改政策,如將現行法定工時修改為32小時,但受訪者普遍不看好以修法方式強行推動週休三日,原因是國內產業結構差異大,且個別勞工也有不同工時偏好,難以匯聚修法共識。
    二、 建議
    從個別與企業角度來看,應該強化勞資協商及內部溝通機制,國外許多週休三日計畫係由勞資協商出來,並非由政府強制規範;另一方面國內目前無大型的週休三日試驗計畫,可能無具體試驗數據及結果說服資方實施,因此建議可以開辦週休三日試點計畫。
    The topic of the four-day workweek has garnered widespread attention in recent years among the Taiwanese public. However, there is currently no relevant research on whether this system is suitable for implementation domestically. This paper aims to explore the feasibility of adopting a four-day workweek in Taiwan through an analysis based on three major dimensions: economic feasibility, legal feasibility, and policy feasibility.
    The study employs a literature review method to collect data on the trial results, impacts, and current working hour systems of various countries that have experimented with a four-day workweek. Additionally, qualitative research is conducted through interviews with representatives from various sectors within Taiwan to draw conclusions and provide recommendations. The findings are summarized as follows:
    I. Conclusions
    Economic Feasibility:
    While international trial results have been overwhelmingly positive, respondents commonly expressed concerns that a four-day workweek might create operational challenges for businesses, such as exacerbating labor shortages and increasing costs. Therefore, significant obstacles exist in this dimension.
    Legal Feasibility:
    Under Taiwan’s current Labor Standards Act, a four-day workweek can already be implemented as long as it does not violate the willingness of employees and is agreed upon by both employers and employees. This means that the four-day workweek is entirely feasible within the existing legal framework.
    Policy Feasibility:
    This dimension involves government action to amend policies, such as revising the statutory working hours to 32 hours per week. However, respondents were generally skeptical about promoting a four-day workweek through legal amendments. The reasons include the significant differences in Taiwan's industrial structures and the varied preferences of individual workers regarding working hours, making it difficult to achieve consensus on such legislative changes.
    II. Recommendations
    From the perspectives of individuals and enterprises, it is essential to strengthen labor-management negotiation and internal communication mechanisms. Many four-day workweek initiatives in other countries were the result of negotiations between labor and management, rather than government-imposed mandates.
    Taiwan currently lacks large-scale trial programs for the four-day workweek, which may result in an absence of concrete experimental data and outcomes to persuade employers to adopt the system. Therefore, it is recommended to establish pilot programs for the four-day workweek to gather practical evidence and insights for future implementation.
