Title:	臺灣植物品種權侵害認定之探討 Determining Plant Variety Rights Infringements in Taiwan

Abstract:	本文探究臺灣法院於植物品種權侵害爭議事件中，影響法院判斷植物品種權侵害之因素。經本研究觀察發現，植物性狀比對分析結果為法院認定是否構成品種權侵害之關鍵依據，然縱有性狀比對分析報告，亦有法院為相反之認定。究其原因，乃係因植物品種為具生命力且需經培育繁殖生長後之成果，不同栽培環境、條件下，同一品種經繁殖後之後代植物性狀表現，容有差異存在。此性狀差異之表現，並不影響其仍屬同一植物品種之事實。法院審理植物品種權侵害案件時，應將此植物品種性狀表現上之特殊性納入考量。從而，在植物品種權性狀之解釋與認定上，應考量前述特殊性，不宜逕依品種權公告所載特性文字，以文義解釋方式限定植物品種權之性狀範圍。
