Title:	強制汽車責任保險之賠償抵充方式與利得禁止原則──臺灣臺北地方法院111年度保險簡上字第35號民事判決

Abstract:	強制汽車責任保險法的立法目的，在於提供交通事故受害人迅速獲得基本保障，而非於損害賠償之外，額外賦予其超過損害賠償的利益。強制汽車責任保險對於受害人的保險給付，具有代替被保險人履行其賠償責任的意義。如受害人已經受領損害賠償，其已受填補之損害，即不得再向強制汽車責任保險人請求給付。強制汽車責任保險所提供的給付項目與數額，雖然與民法上損害賠償的計算不同，但仍應採取總額抵充之方法，以避免超額補償的結果。本件二審判決僅因保險給付與損害賠償之項目與計算方法不同，而准許受害人同時獲得損害賠償與強制車險之保險給付，使受害人獲得超額補償之利益，顯非妥當。
