    Abstract: 本計劃從隋唐國制變動出發,檢討皇帝與法律體系的內在聯繫,嘗試對此「法律現象」 進行政治史的解析。 隋唐國制變動包括:(1)強化中央集權,收奪地方的資源與權力,國制組織化程度提 升。(2)皇帝臨朝主政的制度化,皇帝介入日常國政,成為塑造隋唐政治體系的另一個動 力,改變了皇帝與官僚群體的關係。(3)貞觀初年,個體化官僚制的成立,官人以個體的形 式入仕王廷,形成以「官人」與「本品」為核心概念的身分官僚制。 在上述國制變動下,法律體系也相應發生變化,無論是法典整備或法制更新,成為隋 唐之際顯著的現象,其間的關聯仍待說明。其次,皇帝臨朝主政,法律事務也是國政的一 環,因而頻仍出現「守法」爭議。「守法」爭議反映出隋唐之際政治體系運作的基調,構 成當時政治文化的主要特徵。 本計劃基於上述認識形成基本假說,在此脈絡下考察隋唐時期皇帝與官僚群體在法律 事務上的互動及其歷史意義。
    The first Emperors of the Tang Dynasty upheld the practices of the shortlived SueDynasty regarding the relationship between rulers and the subjects. The debates on this topic during the early Tang period fostered the novel ideas of the “Way of the Emperor” and the “Manner of the Subjects”. This started the doctrine of rulers and subjects working together, which was inherited by the SungDynasty. The study of the “Way of the Emperor” and the “Manner of the Subjects” became the main stream political thought during the early Tang political thought. The “Difan” (The Principles of Being an Emperor) was composed by Emperor Taizong of Tang (598649), which was followed by the “ChenGui” (The Way of the Subjects) by Wu Zetian (624705) and the “Annotation on the Classic of Filial Piety” by Emperor Xuanzong of the Tang dynasty (685762). All three books set examples for the ideas of rulersubject relations. The author wishes to work on this topic, check the related sources and reexamine the relationship between the Emperors and bureaucrats of the Tang dynasty. This project wishes to offer a possible explanation for the emergence of the idea of the “Cogoverning of Ruler and Subjects” and the change of the political roles of the bureaucrats of the Tang Dynasty.
