    Abstract: 最高法院民事大法庭108年度台抗大字第 897號裁定為我國保險契約之強制執行提供了基礎架構，但個案適用仍有疑問。本文接續過去的研究，試圖為執行必要性與比例原則的操作提供方向。本文先介紹最高法院 112年度台抗字第 836號民事裁定等見解。本裁定認為，即使高院不滿意地院就關於保單執行必要性的審酌，原則上即應自行調查認定，而非得一律發回。再者，美國雖採取原則豁免例外許可執行之架構，但當受益人與被保險人非屬於親屬或扶養關係、甚至屬於商號、或是擔保債權之目的時，多數見解認為並不豁免執行。本見解或可供我國法院價值衡量時之參考。
