Abstract:	我國勞基法第49條禁止女工夜間工作甫於2021年8月20日宣告違憲且失效，本計畫擬參國際公約、德國之規範，提出修法建議，主要關於夜間工作規範之立法方針與體系應以特別法或整併於現行第四章之討論；另，探討規範夜間工作之具體內容，以保護夜間工作工避免促發危及人體健康之風險；夜間工作者為兼顧家庭與夜間工作間之平衡措施，亦為要點；及女性勞工於母性保護期間之夜間工作之規定與體系等，均為本計畫擬研究之重點，對於我國夜間工作已為普遍之工作型態，研究結果與之密切有關，將會產生影響；對於已失效之現行法，立法建制亦有急迫與必要性；對於職業安全或勞動檢查等行政部門，於實際執行與夜間工作有關之作業要點，亦具參考價值。
