Title:	無照駕駛之被保險人為遺屬時之保險給付請求權與代位追償──臺灣臺東地方法院111年度東原簡字第12號民事判決

Abstract:	在僅涉及一輛汽車的交通事故中，當受害人死亡時，駕車致生事故的被保險人若同時為制汽車責任保險法第11條第1項第2款規定之遺屬，依法條文義雖亦屬強制汽車責任保險的請求權人，但因其不可能對自己負擔損害賠償責任，基於責任保險原理，不應承認其得請求給付保險金。若該被保險人為無照駕駛被保險汽車致生交通事故，保險人於向其他遺屬給付保險金之後，原得依法向被保險人代位追償。但若該被保險人與其他請求權人之間具有一定親屬關係時，應類推適用強制汽車責任保險法第33條第2項規定，排除保險人代位追償之權，以免發生其他請求權人自為賠償的結果，架空強制汽車責任保險的保障。
