    Abstract: 關於附隨義務之達反是否存有解除契約之可能，學說縱或存有異見，然通說與實務均有限度認可此義務之違反須肇致契約目的不達為要件。惟契約目的不達之義涵究竟為何，義務群之分類方式是否具有決定性之功能，抑或應回歸求諸雙方當事人合意所訂立之契約目的，為本文所關注之重心。同時，透過分析學說與實務之見解可得知，契約目的不達為契約義務違反時解除契約權發生之共通要件，而此核心概念之融入已我國未來債務不履行責任制度提供再造元素。
