    Abstract: 所謂之自然債務(naturalis obligatio)原係指羅馬市民法中,對未踐行一定嚴格方式之契約,因其不存在訴權而無從受裁判上之保護,故唯有依債權人之自助行為或相對人之誠意,始得實現契約內容之債務而言。然因近代契約法以人之意思為契約發生拘束力的根據,故應遵守基於自身意思所生契約義務,再加上實體法與程序法之分離,原「自然債務」之概念因而式微。
