Title:	論未定期限租地建屋契約之終止

Abstract:	我國實務一向以「房屋不堪使用」作為認定未定期限租地建屋契約終止之基準，然民國 99 年民法第 833 條之 1 之增訂後，法院對未定期限地上權，得考慮建物壽命以外之因素，以定存續期間或終止；對未定期限租地建屋契約，卻仍以「房屋不堪使用」為判斷契約終期之唯一基準，於今日社會背景下，稍嫌保守。本文主張，於解釋論上，法院可將未定期限租地建屋契約當事人真意解為「至房屋無法合理使用之日為止」，或就未定期限租地建屋契約類推適用第 833 條之 1 定存續期間或終止；於立法論上，則可參考日本法，整合「租地建屋」和「地上權建屋」兩者之處理。
