    Abstract: 隨著2016年智慧財產局呼籲金融業積極佈局專利的八年來,金融業確實陸續在這期間進行申請,核准數量亦逐年上升。以現今金融科技的趨勢下,科技時代的到來,無疑和傳統金融業之運營模式或服務產生衝擊,不論在業務、流程、產品及後台技術皆發生巨大改變。因此,為保護金融科技創新,延伸出了金融科技專利,一方面保護發明人的權益,另一方面更是防範企業未來恐面臨之不確定風險等要素。
    然在金融業之專利申請上,銀行業為主要主導者,其申請的專利比例相較於保險業、證券期貨業皆高出許多。所以,本研究欲透過2021年榮獲全球最佳銀行之一的民營銀行國泰世華進行專利佈局分析。
    過去,金融科技的研究方向多以金融科技之技術創新與應用分析、金融專利與公司績效的影響、傳統金融產業未來將面臨之挑戰以及所帶來的風險等問題進行分析,鮮少以一個企業已核准的專利數角度對金融科技的發展或佈局策略進行探索。因此,本研究將利用企業已核准之專利數量、國際分類號IPC類型以及類型分佈分析探討其專利佈局模式與未來企業可能發展的方向等。
    研究結果發現,個案公司在三種專利的核准數量上,從2007年到現今僅有44件,其中發明專利4件,新型專利40件,設計專利0件之情況,且一案兩請的數量亦佔據了幾乎一半的數量。在IPC分類上以利息計算、授信、抵押、家庭銀行或線上銀行之G06Q類型居多。主分類上雲端服務及大數據上皆有一定數量的專利佈局,但區塊鏈及AI方向的佈局卻極少之情況,行動金融方面雖有佈局但數量不高,亦說明其專利佈局策略還有很大的進步空間。
    疫情推動了各產業運用數位方式的需求提高,更是企業數位轉型的催化劑,銀行業亦如此,金融科技是銀行業在永續成長上不可忽視之存在。因此,在Fintech的浪潮下且企業的預算有限的情況下如何獲取有效的專利?如何進行專利佈局策略?皆為銀行業需斟酌之要件。
    To promote the development of a patent portfolio, the Intellectual Property Office started an appeal to the financial industry in 2016. Nowadays, the financial industry has indeed applied for patents and the number of patent approvals has also increased by the year. Under the trend of Fintech, technology is quickly disrupting the financial services not only in business, processes and products but also in the back-end industries. Hence, Fintech patents have been extended to protect fintech innovation. The patent can protect the rights of inventors, and against the uncertainty risks that enterprises may face in the future.
    However, the banking industry is the main leader in the patent application of the financial industry, and its ratio is much higher than insurance, the securities and futures industry. As a consequence, this research intends to analyze Cathay United Bank of patent portfolio which had been awarded as one of the world’s best banks in 2021.
    In the past, the research was mostly according to the technological innovation and application analysis of Fintech, and the challenges of traditional financial industry will face in the future, but rarely to explore the strategy of the patent portfolio from the number of patents approved. Therefore, this research will use the number of patents approved, using the type of the international classification code, and the type distribution analysis to discuss its patent layout mode and the possible development direction of the company in the future.
    Cathy United Bank has approved only 44 patents since 2007, which including 4 invention patents, 40 utility model patents, and no design patents at all. The number of two applications for the same creation also accounted for almost half of the patents. In the IPC classification, the types of credit extension, the calculation of interest, mortgage, home banking, and online banking are mostly used for banking business. In the main category, there are a certain number of patent portfolios in cloud services and big data, but there are very few cases in the mobile payment, blockchain and AI. In other words, they have still a long way to improve the strategy of the patent portfolio.
    Now, the epidemic has boosted the demand for the use of digital methods in various industries, and it is also a catalyst for the digital transformation of enterprises, the same goes for the banking industry. Fintech cannot be ignored in the sustainable growth of the banking industry. So, it is crucial that the enterprise consider how to obtain effective patents in the wave of Fintech under a limited budget and how to manage their strategy of the patent portfolio.
