Abstract:	本文以結婚與兩願離婚要件之立法沿革出發，觀察行政法院與民（家）事法院針對結婚與離婚登記所發生之裁判爭議，檢視在現行法的架構下，賦予戶政機關之結婚與兩願離婚具備創設登記效力之適切性，以及釐清戶政機關在創設登記下所應具備的權能，並以德國相關法規範進行比較，提出我國民法中有關結婚與兩願離婚之形式要件應予修正之內容。
