Abstract:	民事訴訟法第259條規定，被告得對於原告及就訴訟標的必須合一確定之人提起反訴，其中對於必須合一確定之人提起訴者，學理上稱為第三反訴。然反訴之類型頗為多樣，在訴訟經濟、擴大訴訟紛爭解決及避免程序過度複雜化而導致審理案件負擔加劇，其如何平衡，仍有諸多討論空間。
