Title:	由電腦軟體相關發明論專利法之發明評價與界限 Evaluation of Computer Software Patent Eligibility under Patent Law

Abstract:	鑑於美國專利法以及其相關專利判例法，無論專利審查或專利侵權無效抗辯方面，在電腦軟體相關發明之發明評價，具有豐富之經驗，近年來之法院判決發展更是值得重視。因此，本文嘗試以美國專利法及其判例法發展之借鏡為出發點，結合發明評價之應有方向，對於我國專利法發明評價之現況提出解析與建議，盼能喚起學界與實務界對於專利法發明評價相關問題之再省思與關注，期待能引入各方進一步更精湛之討論。最後，本文之論述內容是以發明專利為中心，並不討論新型專利以及設計專利之專利適格標的，還祈明鑒。
