Abstract: | 全球化的今日,隨著國際間便捷的交通和頻繁的交流,每一個人都有成為外國人的機會,保護外國人的權利實是國際法迫切而必要之焦點。縱然國境管制係國家本於主權的權利,驅逐外國人則是主權的展現,然而,外國人的身分不表示被屏除於國際人權法的保障之外,也不代表國家得以任意驅逐之。是此,如何權衡國家的驅逐權和國際法對人權的保護,是首要而核心的問題。 鑑於國際法委員會對驅逐外國人之主題曾進行龐大且深入的研究,2014年提出《驅逐外國人草案(Draft articles on the expulsion of aliens)》,反映並整理出當前國際法相關規則和依據,具有相當重要性和研究價值。 本研究欲以《驅逐外國人草案》為基礎,探究當今國際法和國際人權法上驅逐外國人之相關規則,並藉國際法庭之案例和各國評論了解相關實踐現況或困難,期望在草案內涵之外,能對議題的發展有更實質的了解。最後,對照《驅逐外國人草案》和相關公約內涵,提出我國驅逐外國人法制和執行上的六項建議,以期對我國移民行政和立法發展上有所助益。 |
