Abstract:	就商標註冊之立法例而言,國際間可以分為先申請主義與先使用主義。前者(先申請主義first-to-file)乃是以申請人向各國商標機構申請註冊的先後,作為是否取得商標的依據;至於後者(先使用主義first-to-use)目前僅有美國採用,也就是以商標是否先在州際或國際貿易中使用,而不以申請註冊的先後,作為決定是否取得商標專用權的基準。
