Abstract: | 當代自由民主憲政國家,以國民主權原則作為憲法核心價值,強調國家的意志與權力來自於人民,並保障人民政治參與的權利。其中,投票作為人民行使各項參政權的典型與基礎,乃民主制度所不可或缺,故除了在各國的憲法多有明文對投票權的保障外,國際人權法也將之作為基本人權。
在投票權的保障內涵中,一人一票的普通原則乃是最基本的要求,惟對於精神與智能障礙者而言,他們的投票權卻長期受到普遍剝奪。其剝奪理由,不外乎是認為他們不具備理性思考能力,無法嚴謹審慎地評估自己所為的決策,難以與其他公民一起合作形成國家或公共事務的決定;抑或是,擔憂他們容易受到不當操控與影響,進而減損了民主投票的完整性與確實性。因此,不論是在政治哲學、各國法規範,或國際人權法的脈絡中,剝奪精神與智能障礙者的投票權常被視為正當合理。
然而,對此情形,聯合國於2006年通過的《身心障礙者權利公約》儼然成為扭轉的關鍵。透過該公約對身心障礙者融合社會價值的強調,及對平等規範內涵的重構,精神與智能障礙者「平等參與政治」的圖像逐漸顯現。同時,該公約所具有的規範效力,也對各締約國的法制產生一定程度的指引,除了促使對精神與智能障礙者主體性與權利觀的反思,更在投票權的保障實踐上,呈現嶄新的人權趨勢。
本文旨在研究《身心障礙者權利公約》對於精神與智能障礙者投票權的保障。除解析該公約對投票權保障的規範內涵,亦透過比較觀察歐洲區域內司法裁判與法制變遷,針對過往排除精神與智能障礙者投票權的觀點與法規範重新檢討,並探求該等公約保障於我國法體系中加以落實的具體途徑及作法。 |
