    Abstract: 針對有線電視頻道代理商 2016 年頻道授權要求以行政戶數 15%作為最低計費標準,對於新進系統業者是否構成不當差別待遇,本文依公平交易法第 20 條第 2 款的四項違法要件,逐一整理比對公平會行政處分與四組法院判決的主要理由,並且抽離出本案審理至今所浮現的兩大問題。首先,此授權金收取標準的高額度與市場封阻性並未得到充分呈現與重視。其次,本案司法判決大多拒絕從系爭授權金標準對於新舊系統業者所造成的巨大差別影響,認定構成差別待遇。此見解忽略當前實質平等觀已將「不等者應不等之」納入其概念內涵,也很容易遭到業者規避閃躲,並不妥當。
