    Abstract: 本件上訴人主張：被上訴人熊○○原獨資經營○○時尚醫美診所（下稱「○○診所」），擔任醫師，並聘僱被上訴人蘇○○在該診所從事醫師職務。伊於民國（下同）102年12月22日向該診所購買玻尿酸產品，於103年1月4日至該診所接受鼻型雕塑手術（下稱「系爭手術」）。惟蘇○○於施作系爭手術前，並未對伊進行體質測試，且於施打前未做回抽以確定注射針頭不在血管內，亦未告知植入玻尿酸整型材料風險及就術後應注意事項善盡說明義務，僅告知術後3日會有紅腫情形，只需早晚各冰敷20分鐘即可。
