    Abstract: 德國聯邦憲法法院從法治國原則,導出德國內國各級法院有義務以無違於一般法律解釋之方法,在判決中適用歐洲人權公約併同同意歐洲人權公約在德國內國發生拘束力之法律,並且考量歐洲人權法院相關判決之見解為判決,此乃運用「有利於國際法的解釋方式」。此方法之目的在使德國聯邦憲法法院及各級法院於個案審查時,能將歐洲人權公約之規定與歐洲人權法院之判決見解納入基本法價值體系以融合為不相牴觸之整體。本文先就「有利於國際法的解釋方式」通用之方式與界限為介述,再以卡洛琳公主案-II 為例,觀察此解釋方式在個案中如何被具體操作以落實基本法對國際法採取友善態度之立場,最後探討本研究成果對我國憲法解釋有何啟發與可供參酌之處。
