Title:	一般警察人員特考年齡限制之合憲性--評北高行103年度訴字第1576號判決並借鏡歐盟法觀點

Abstract:	年齡是一項常被用來作為差別待遇的標準。本文以「一般警察特考報考年齡限制」為例，探討審查公務人員應考年齡限制合憲性應考量之憲法原則與規定。類此爭議曾出現在歐洲法院Wolf案判決中，因此本文擇定歐盟禁止年齡歧視立法與歐洲法院Wolf案作為比較法素材。接著分析我國與系爭問題有關之憲法規定及大法官解釋，嘗試推導出應適用之審查標準，並據以評析北高行一○三年度訴字第一五七六號判決中，考試主管機關與法院對系爭應考年齡限制之合憲性所表示之見解。最後，以歐盟法禁止年齡歧視之相關規定及歐洲法院Wolf案判決為鑑，抽繹出可供臺灣作為借鏡及啟示之處作為結論。
