    Abstract: 於立法制定「私立高級中等以上學校退場條例」（草案），以建構私校退場機制之際，有關學校財產土地之處理，亦為社會矚目議題之一。本文從現行土地相關法規關於土地使用管制規定之觀點出發，針對該條例草案所擬建構之私校退場機制，特別是以其中有關專案輔導學校所屬學校法人改辦其他教育、文化或社會福利事業之相關規定為焦點，闡述其所涉及有關土地校產處理面向應考量之法律議題。期能對於私校退場條例草案之立法，乃至完成立法施行時，其應有之配套或補充規範，得以從更宏觀、全面、合理之角度，思考私校土地處理問題。
