    Title: 論民法親屬編之修正

    Abstract: 民法親屬編制定於一九三年,制定前有五個草案,亦即:一、一九一年之大清民律草案;二、一九一五年之民律親屬編草案;三、一九二五年之民律草案親屬編;四、一九二八年之親屬法草案;五、一九三年之民法草案第四編親屬。大清民律草案、一九一五年民律親屬編草案及一九二五年之民律草案親屬編,內容大同小異,存在著男尊女卑之觀念及父權主義之色彩。一九二八年之親屬法草案,則兼採大陸、英美兩派之長,並參考外國之立法例,為求切合社會上現實之要求,並不為傳統因襲觀念所束縛,乃樹立三大基本原則。亦即,一、承認男女平等;二、增進種族健康;三、獎勵親屬互助而去其依賴性,此草案因立法院尚未成立而被擱置,雖未及發生效力,惟卓著革新之精神,實為我國立法上之一大進步1。一九三年制定之民法親屬編,大多承襲一九二八年親屬法草案之立法精神,依民法親屬編起草說明書之立法原則有七,亦即:一、改進親屬之分類;二、確立男女平等;三、增進種族健康;四、釐定夫妻財產制;五、廢除嫡子、庶子、嗣子及私生子等名義;六、獎勵親屬互助及獨立;七、規定家制2。自一九三年制定民法親屬編後,至今經過五次實質內容之修正及一次法律用語之形式修正3,本文僅就五次實質內容之修正背景及修正內容作一簡單介紹。
