    Abstract: 中國大陸任意拍賣法律關係的構成,是中國大陸任意拍賣中當事人權利義務的分配以及拍賣實踐中一些法律問題的關鍵之所在。對於這一問題中國大陸的研究甚少,本文結合比較法對該問題做了分析與討論。第一部分主要解釋了在有關中國大陸任意拍賣的商業與司法實踐中出賣人是誰這一問題的核心是拍賣人以何人之名義行事,進而釐清任意拍賣法律關係之構成 ; 第二部分結合歐美經驗與中國大陸法律規定,分析中國大陸任意拍賣法律關係的構成路徑 ; 第三與第四部分反思了中國大陸任意拍賣制度與中國大陸現行法律體系接軌時的問題,並對任意拍賣法律關係的法律適用做更深入的分析與解釋。
    The composition of the legal relationship of arbitrary auction in mainland China is key to the distribution of the rights and obligations of the parties in the country’s arbitrary auction as well as some of the legal problems in the auction practice. Regretfully, there have been insufficient researches on this problem in mainland China. This paper aims to analyze and discuss the problem with comparative method. The first part mainly explains the identity of the seller in the commercial and judicial practice of arbitrary auction in mainland China. The second part analyzes the path of the legal relationship of arbitrary auction based on the experience of Europe and America and the legal provisions of mainland China. The third and fourth parts reflect on the connection between the arbitrary auction system and the current legal system and make further analysis and interpretation on the application of the arbitrary auction’s legal relationship.
