    Abstract: 締結婚姻與組成家庭之權利，是同性人權保障運動的重要目標之一。近年來，同志運動在我國的發展日益蓬勃，民間倡議多元家庭的呼聲四起，卻仍然無法在法制面上獲得回應。如今，愈來愈多國家紛紛開放同性婚或允許同性伴侶組成家庭，我國確實應正視此一問題，仔細考量是否以及如何保障同志作為公民所得以主張之婚姻與家庭權。本文乃以德國為加強保障同志之婚姻權與家庭權之立法歷程為主要內容，藉由參考德國在面對此一議題所面臨的衝突以及所採行之措施，而為我國提供或可借鏡之處。
