    Title: 從人權保障的觀點審視人工生殖法制所面對的難題-兼論幾則歐洲人權法院的判決

    Abstract: 人工生殖科技發展對社會以及法制所帶來的衝擊,各國皆有其因應的對策。然而因為其中的差異,在全球化的今日,造成諸多問題。本文藉由歐洲人權法院在此一領域中的相關判決,試圖指出在傳統內國法對於人工生殖的規範方式可能有所不足之處,特別是對瑜何種人工生殖方式可被認定是合法的爭議,嘗試提出更深入的論證。尤其該注意的是,各國在此一領域的立法,不應再以抽象模糊的理由為基礎,而是應該對可能侵害人民生殖權利的管制措施提出具體的論證,尤其是比例原則的嚴格適用,方不致對於人民的基本權利造成過度的限制,甚至是侵害。
    The advent of assisted reproductive technologies (ARTs) has imposed great impacts on societies and legal systems. Facing the new legal challenges, countries have adopted different strategies and legislations to regulate ARTs. However, different ARTs legislations between countries have caused more problems. After examining some of the decisions issued by the European Court of Human Rights in regard to ARTs, this article then argues that the current domestic regulations might be insufficient to cope with legal issues arising from the use of ARTs. This article therefore proposes that the ARTs legislations, including varied ARTs` legitimacy, should be established on the basis of concrete and valid theoretical bases, such as the principle of proportionality, rather than abstract and ambiguous rationales. In other words, whether the Arts legislations disproportionally and unjustifiably restict individuals` basic human rights should be carefully articulated.
