    Abstract: 本文以智慧財產法院106年度民專上字第28號民事判決為論述基礎而開展，特別就專利權均等侵害之禁反言原則，以及該原則之例外，聚焦於「關聯性甚低」抗辯（本文稱為「偏離修正目的之抗辯」），透過均等侵害之法理以及比較法之視野，由實體與程序二方面，重新檢視專利權均等侵害之禁反言原則，並探究「關聯性甚低」抗辯之本質，以及其與禁反言原則間之關係。在禁反言法效方面，本文亦就「嚴格適用」與「彈性適用」之爭議，釐清二者之適用目的與基本觀念。
