    Title: 給付型不當得利的返還

    Abstract: 某甲年十二歲,因家貧無以為生,乃在乙開設之成衣廠,應徵擔任童工,從事襯衫翻領工作。由於年齡太小,不符勞基法規定,甲乃偽稱其已滿十五歲,而為乙所僱用,言明工資每月五千元,每作滿一個月發薪一次。於將滿一個月之前一日,有勞工局人員前來查核,發現甲年齡不足,不准其再工作。甲乃向乙請求工資,乙表示契約既屬無效,其自無給付義務,甲之監護人丙認為,勞工局之處分違反憲法第十五條之規定,應不生效力,契約仍應有效,故乙仍有給付義務。試析其法律關係。
