Title:	里長法律地位及其支給費用之研究

Abstract:	里並非地方自治法人,從而,里長不論是官派或是遴聘,應該只是地方自治團體派駐在該行政區域的分支機構。從里長的職務觀察,其係依法令從事公務的最廣義公務員,惟並非受有俸給之文武職公務員,應非公務員服務法上所稱公務員。另外,里長雖係民選人員,但是其並未享有官等及薪俸,與其他民選行政首長亦屬有別,而屬榮譽職。然榮譽職並非完全付出而沒有補償,參考德國地方自治法規,榮譽職公務員仍享有收入損失、津貼、其他墊款費用等補償請求權,即為榮譽職補償請求權。基於我國里長職務的公共性、公益性,似可參考德國榮譽職公務員制度,以期建立去政治化、人性化與法制化的制度規範。
