Abstract: | This paper presents a qualitative analysis of the current litigation finance industry business model. What began as a simple investment of single lawsuits quickly evolved into today’s more sophisticated investment fund driven model. Litigation finance companies now financially support a much more sizable amount of the global legal market’s litigation needs. The litigation finance industry’s growth attracts more funding requests and investor attention than ever before. The litigation finance industry still receives a lot of criticism from regulators despite its rising popularity. This paper first explains the necessity of litigation finance, how litigation funding agreements operate, and who seeks funding. It shows why litigation finance receives wide-spread adoption and acceptance by civilian, commercial, and government entities around the world. Then, it explains why many types of investors and traditional investment funds find litigation finance attractive enough to add it to their portfolios. It explains how legal asset risk is accurately assessed and diversified in order for litigation finance companies and their investors to bear it when funding legal assets. Case studies featuring two publicly traded litigation funding firms showcase successful evolving business strategies used by the industry to satisfy investors and shareholders. These business strategies illustrate how to measure the performance of litigation finance companies. They show how they add value to the legal market. They also depict the dependent relationship deepening between litigation finance companies and the global legal industry. |
