    摘要: Legal consciousness 乃美國法律與社會研究的重要學術概念。本專書撰寫計畫將 （1）與此一西方所發展的學術概念對話，（2）提出一套在地分析框架或理論， 並（3）改寫／重寫作者過去十多年經驗研究成果，出版成書。西方法意識理論 多半偏重於詮釋人們的認知框架，聚焦於法律改革提升法律意識，或者法意識文 化實踐之霸權的日常建構；然而，從申請人的經驗性研究發現，權利意識除了認 知之外，亦是情感或情緒的活動。針對權利是否以及如何成為人們對生活事件的 主要詮釋資源，本專書撰寫計畫提出一個人際糾紛或衝突的在地理論，稱為主體 性認知與情感衡平的三重共構，這包括：「情」的事實與規範建構、對權威的信 念、以及公共性的參與確認。本專書撰寫計畫將以六個經驗性研究，分別展演上 述主體性三重共構的具體意涵。權利意識之主體並非自由主義意義下的主體，三 重共構的在地實踐，取決於其歷史、文化與全球位置，而權利意識的研究有必要 刻劃在地主體性的多重、多樣與多變，甚至矛盾、偽裝與可分割等特性。
    This project intends to join the academic conversation on the concept of legal consciousness, aims to rewrite the applicant’s previous empirical data, and publishes its theoretical as well as practical contributions. Socio-legal scholars have focused on how law reforms enhance legal consciousness or legal consciousness as hegemony that structures everyday life. This project emphasizes the feature of balance in interpersonal dispute or conflict, and proposes an analytical framework of three themes of how cognition and emotion balance. The three themes include “qing” (emotion or genuineness) as the construction of facts and norms, the effects of social authority on law’s legitimacy, and the social recognition of law’s role in publicity. This project suggests emphasizing the construction of subjectivity in a particular historical and cultural context. It is important to demonstrate how the subjectivity is contingent, fluid, plural, contradictory, and partible.
