    Abstract: 重建刑事司法:一個人權批判的觀點 刑事司法的原始設計是一種保障人權的機制,但此機制也可能導致人權的侵害。在十多年來許多關於台灣戰後司法制度發展與改革的論述中,人權的觀點與角度成為一個亟待面對的急迫問題。然而,在建立人權批判的觀點之前,我們首先必須回答以下的問題:這些論述如何看待人權?司法如何構成人權的侵害?其原因為何?我們應如何針對現狀提出人權批判的觀點,並且促成政策性的建議與改變?司法促成正義的重要機制何在? 本計畫的目的有三:第一,分析刑事司法制度的歷史發展,並說明刑事司法人權典範的形成與變遷;第二,從人權的角度考察刑事司法的現況,並進行人權實證發展的社會分析;第三,結合文化批評理論與批判法學理論,發展一個人權批判的觀點,以便形成人權規範的制度。 上述刑事司法制度的文化反省,包括:檢察權力的削減與檢察功能的發展、刑事訴訟制度的改良與事實認定的文化、檢察內部的透明化與民主化。此種文化反省需要一個理論框架,來說明司法過程的本質,及其對於人的意義。 發展此種人權批判觀點的策略,首先應將法律放在社會語境中,將之當成政治與權力的事務。其次要重新整合法律、政治與權力的功能,必須如同法律現實主義所主張的,去超越法律形式主義對於確定性的追求。同時,我們必須要認識到法律所具有的文本性 (textual nature),而致力於在敘事中揭露更多的現實,並尋求倫理的行動。 本計畫將進行三年。第一年我們將致力於刑事司法發展歷程的分析,以及理論的初步探索;第二年我們將發展跨領域的合作,以及理論與實務的對話;第三年我們將與整合型計畫之其他子計畫共同研討,在理論上發展人權批判觀點,以便從事現實批判與提供政策建議。 
    Reconstruct Criminal Justice System: A Critical Perspective of Human Rights The present criminal justice system originally designed for safeguarding human rights has not avoided the risk of violating human rights. In Taiwan, the last decade has witnessed the urgency of developing a critical perspective of human rights and several judicial reforms have ensued. In response to the urgent call, the present paper, therefore, proposes to bring a critical perspective of human rights to reconstruct the system. We take the first step by posing the fundamental questions: In what ways do the current discourses treat the issue of human rights? How and why are human rights violated in the criminal justice system? How should we design a mechanism to monitor the criminal proceedings and further the change of related policies to realize justice? Our goal throughout will be threefold: first, to analyze the historical development of the criminal justice system and its correlation to human rights; second, to examine the present situation of the system from the perspective of human rights; third, to develop a critical perspective of human rights by integrating cultural critical theory and critical legal theory. As such, the present project will embark on an examination of the system, including the decline of the persecution power, the reform of the criminal procedure, and the accountability/democratization within the internal prosecution system. This cultural examination is in drastic need of a theoretical framework to explain the nature and significance of the whole legal process to the people involved. The development of a critical perspective of human rights should prioritize the law in the context of social and cultural reality and make it as a matter of politics and power. We should transcend legal formalism’s pursuit of legal certainty and reconstruct the mechanisms of law, politics and power. On top of all these, we should acknowledge the textual nature of law to get closer to the truth. And accordingly, the need for an ethics is called for. It will take three years to complete the present project. In the first year, we will analyze the historical development of criminal justice system and work on theoretical explorations. In the second year, we will work with scholars from various disciplines and initiate dialogues with legal practitioners. The third year will be the integration of the individual projects of the integrated project. We will then develop a critical perspective of human rights and offer suggestions for legal policy.
