Title: | 企業智財部門組織結構之探討 The Organizational Structure of Intellectual Property Departments |

Abstract: | 隨著知識經濟時代的到來,企業在伴隨著技術創新而成長的同時,也漸漸開始重視智慧財產的管理,智慧財產的價值鏈也不再僅限於傳統的侵權訴訟領域,而已逐漸發展成為橫跨產業鏈上下游的智財生態系統,不論是從上游的研發活動,到中游的專利申請與佈局,到下游的商業化模式等等,每個環節都需要有專業的智財人員參與其中方能完成。 綜觀我國企業近二十年來就智財部門在組織規劃上的樣態,有將智財部門隸屬於中央單位者,有將其隸屬於地方單位者,其中智財人員有歸屬於研發部門者,也有隸屬於法務或行政部門者。然而,不論企業採取何種組織結構,其與智財部門之職能設計間似應具備一定的關聯性,又在不同的組織隸屬與配置之下,智財部門在進行跨部門溝通上似乎都有其困難與受限之處。 相較於研發管理的眾多學術研究,有關智財部門的組織結構探討則較為缺乏。因此,本研究從組織的觀點切入進行個案研究,透過五家個案企業的深度訪談,分析在不同組織模式設計之下,對於智財部門相關職能的影響與運作成效為何,並提出以下發現:企業智財部門在組織設計的選擇上,與營運需求、產業競爭環境、以及企業的文化與價值間有高度的關聯性,而因組織結構隸屬不同所造成的利益分歧、部門間低度互信與錯誤認知則是造成跨部門溝通障礙的主要因素。 With the advent of the knowledge economy, companies grow with technology advancement and have begun to place more emphasis on intellectual property (IP) management. IP value chain not only matters in conventional litigations in IP infringement, but has gradually led to an ecosystem that plays an important role in both upstream and downstream in an industry. Starting from the upstream R&D to midstream patent applications, and downstream business models, every stage of a company’s supply chain will not function properly without professional IP personnel. When it comes to the planning and structure of IP departments in Taiwan over the past two decades, some are established at the parent company, while others at the subsidiary corporations. IP personnel can be found affiliated with R&D, legal, or administrative departments. That being the case, any of the above-mentioned structures should be adopted in accordance with the functions and design of the IP departments. However, under different task assignments and organizational structures, there seem to be difficulties and limits for the IP departments to conduct interdepartmental communication. Compared with studies on R&D management that come in a large number, there is less research on the IP departments and their organizational structures. For this reason, this paper focused on cases of five companies through in-depth interviews, from the perspective of an organization, to analyze the impact that different organizational models have on the functional design of the IP departments and their operational outcome. Results revealed that the design of the IP departments and their organizational structures is highly correlated to industry environments for competitions, operational needs of a company, and corporate culture and values. On the other hand, the interest divergence as well as lack of trust and misconceptions among departments, resulting from different organizational structures and responsibilities, are the main factors causing barriers to interdepartmental communication. |
