    Title: 定額給付型健康保險契約過度重複之制約

    Abstract: 甲以自己為要保人暨被保險人，向A、B、C、D、E、F、G等7家保險公司投保定額型住院醫療保險，約定「住院」即給付每日新臺幣（下同）3,000元之住院醫療保險金。另，甲又分向H、I、J、K、L、M、N等7家保險公司投保重大傷病保險，亦均約定住院日額3,000元，並約定經取得健保署認定之重大傷病證明，即給付重大傷病保險金30萬元。其後，甲經診斷確診為冠狀動脈血管阻塞，須接受冠狀動脈繞道手術，共住院7日，自費部分支出醫療費用60,000元。而甲即持診斷證明，向A至G等7家保險公司請求給付住院日額保險金共14萬7千元，亦向H至N等7家保險公司請求給付住院日額共14萬7千元，並請求總額210萬之重大疾病保險金。設甲與各保險公司訂約時，均未告知各保險公司有向其他保險公司投保之情事，問：各家保險公司有無給付保險金之義務？
