    Title: 出租人之修繕義務與承租人之自行修繕權

    Abstract: 甲將其所擁有之A屋出租予乙作為住宅之用,租期自2016年1月1日至2019年12月31日止,租金每月新臺幣(下同)20,000元,甲乙雙方因此成立一書面租賃契約。不料,於2017年7月間A屋發生嚴重漏水現象,乙在未徵詢甲之意思下,竟擅自雇工修繕,同時搬離A屋,俟1個月修繕完工後,乙始再行遷入A屋居住。惟對於此一修繕工程,乙共計支出材料費5,000元以及工資10,000元。稍後,乙向甲主張:甲應償還乙因自行修繕A屋所支出之費用共計15,000元,抑或乙得於其所應支付之租金中扣除此等費用。乙同時主張:因A屋漏水進行修繕,其有1個月未能使用A屋,乙無庸支付此1個月之租金。然而,乙之主張全遭甲斷然駁斥。試問,甲或乙之主張是否有理由?一、承租人修繕費用償還請求權之前提。二、無因管理或不當得利之相關規定適用於承租人自行修繕租賃物之可能性。三、承租人未經催告而自行修繕租賃物得向出租人為如何之請求。四、承租人因租賃物出現瑕疵未能使用租賃物之價金危險負擔。
