    摘要: 本文研究背景為2008-2009年金融海嘯降低人民對於「市場」自動維持秩序的信心。本文嘗試回答三個問題，首先，國家對於市場的參與或規範，應當遵守何種憲法界限？其次，經由何種程序確保國家遵守憲法界限？或確保國家履行憲法課與的義務？最後，憲法規範內容是否變遷？如何變遷？本文嘗試由憲法規範內容，以及其相關程序兩個角度討論憲法變遷的概念，以及對於我國當前憲政的意義。
    This article is written against the background in which people’s confidence in the ability of “the market” to adjust itself has been lowered by the 2008-2009 financial crisis. This article tries to answer three questions. What are the limits set by the Constitution for the participation or regulation of the market by the state? Through which procedure can such limits be enforced against the state? Do these limits change over time, and how? This article approaches the notion of transformations in constitutional law from the perspectives of constitutional norms and its related procedure, and discusses the implications for our contemporary constitutional practice.
