Abstract:	犯罪行為可分為故意與過失等不同類型，故意犯是刑法主要非難對象，過失犯相對於故意犯，則屬於刑法為了有效保護特定法益，從而擴大處罰範圍的犯罪形態，質言之，刑法主要處罰有意侵害重要利益的行為人，過失行為人欠缺積極侵害利益的意志，一般情況下不會構成犯罪，不過，倘若行為人出於過失而侵害的法益非常重要，刑法仍會基於保護該重要利益的理由，將處罰範圍從故意侵害該法益的行為擴大到過失侵害，在此意義下，刑法不可能單純處罰過失侵害法益的行為，過失犯的成立，一定要該「侵害法益行為與結果」有相對應的故意犯制裁，才能處罰過失犯。
