Abstract:	各國政府近來莫不對日益興盛的第三部門進行管理，讓第三部門得以在法的軌道上運行。本文認為台灣應就第三部門的特性及其與國家、社會間之關係，整合不同型態的第三部門組織（如準NGO、公設財團法人、NPO、NGO等），從《行政法》（公法）的角度，將現行雜亂分散且定位不明的法規（如《民法》、《人民團體法》、《志願服務法》、《公益勸募條例》、《各目的事業主管機關監督管理準則》等）做一整合，制定一部「第三部門基本法」（或可稱之「公益法人組織設置與管理條例」）。基此，本文擬從第三部門之性質著手，進而檢討現行台灣法律規範的問題，且討論第三部門的法律關係，最後嘗試草擬一部「第三部門基準法」，以供日後立法參考。
