    Abstract: 金融控股公司法除引進金融控股公司組織之跨業經營模式外,並明定金控集團得以共同行銷方式提供跨業之綜合性金融商品或服務,期能提昇其經營效率。為金融控股公司法對於金融控股公司之轉換及分割設立,金融控股公司間之事業結合及金控集團之共同行銷等事項,涉有諸多不同於公平交易法之特殊規範,而與公平交易法所規定之事業結合管制及搭售行為規範在具體執行上,難免引發法律適用之衝突。因此,如何建立政策、法律適用及執行之協調機制,實為值得探討之課題。本文首先探討金融政策與競爭政策之關係,一方面介紹我國金融政社之最新變革,二方面就金融控股公司法及公平交易法之政策衝突。其次,除探討限制競爭規範及不公平競爭規範適用於金融集團時所應注意之相關問題外,並輔以比較法制之分析,期能借重他山之石,作為執法及修法之參考。最後,則提出本文之簡要結論及建議。
