Title:	退避義務與防衛手段的必要性

Abstract:	被告甲與乙為朋友關係，乙與丙曾論及婚嫁但後來發生糾紛。丙某日去找乙，卻發現甲駕駛小客車搭載乙，丙認為甲是乙之新男友，乃駕駛自用汽車阻擋甲車前進，丙下車拍打甲車車窗，接著跳上甲車引擎蓋，再以腳踹擊車前擋風玻璃造成龜裂，丙繼續跳至車旁拍打車窗，甲見狀下車試圖制止丙，丙拉住甲，出拳毆打甲頭部左側，甲為阻止丙繼續攻擊，伸出左手阻擋丙，右手朝丙臉部揮擊，再以左手推丙，丙跌坐在地，雙方打鬥才告停止。丙受有右側眼瞼及眼周圍區域鈍傷、口腔表淺損傷、口腔擦傷、右側膝部挫傷、右側小指挫傷等傷害 ; 甲則右手與膝部有輕度挫傷。
