    摘要: 國際環境組織與公約的發展,係於1970年代以後迅速的透過大量的環境條約之締結展開,而同時,台灣於1971年退出聯台國之後,有相當長的一段時期與國際社會之互動不深,也因此對於國際環境法於1970年代之後的發展,並未能參與其中,導致政府對於國際環境法制的狀況不甚瞭解。直到1992年,因為犀牛角保育事件,政府首次與國際環境公約「交手」,至此,政府方逐漸感受到有必要參與國際環保組織與公約,也著手規劃參與事宜。於相關組織與條約的法律規範以及國際現實考量的情況下,台灣正式參與的可行性有多高?而目前此種參與的現況對台灣的意義為何?本文將依據研究者自身參與相關事務的經驗,針對上述議題提供一些觀察與心得,供政府部門以及從事相關研究的學者參考。本文的結論為:建議政府對於參與國際環境組織與公約,必須先思考正式參與的目的為何,才能進一步的著手進行如何參與的策略、可行性、以及各種策略的利弊分析。
    The development and establishment of international environmental institutions and multilateral environmental agreements began to proliferate rapidly after the 1970s. Meanwhile, Taiwan retreated from the international society after its seat in the UN was replaced by China. As a result, the government was unaware of and unfamiliar with the rapidly developing international environmental law. The formal encounter with multilateral environmental agreements only came in 1992 when Taiwan was threatened by CITES of possible trade sanctions for its poor conservation record. This incident triggered the interests the government place on international environmental institutions and agreements. The government began to pay more attention to international environmental institutions and agreements and try to participate more actively. Under the existing legal regulations as well as international political situation, what is the feasibility of Taiwan`s formal participation in these international environmental institutions and agreements? And what are the implications of the current participation through non-governmental organizations? Based on the researcher`s own experiences, this article seeks to answer these questions and provide some observations and policy suggestions. The paper concludes that the government needs to ponder on the question of `why` do we want to participate in international environmental institutions and agreements before trying to look for and analyse ways and strategies to formal participation.
