Abstract:	WTO仲裁制度是以普通仲裁條款為核心，以特殊仲裁條款為輔助，以DSU之外其他協定仲裁規定為補充的多層次法律制度。第三方憑藉其獨特的地位，在WTO爭端解決中發揮著越來越重要的作用。目前，幾乎所有進入WTO爭端解決程式的案件都會有一個或多個第三方參與其中。雖然DSU對第三方介入制定了一些原則規定，但是這些規定主要適用於評審團審理程式，對於仲裁中的第三方介入幾乎沒有涉及。在實踐中，WTO仲裁員在缺乏具體規定時，除了類推適用評審團審理中有關第三方的規定外，還會處理第三方在仲裁中的准入資格及權利等問題。因此，WTO仲裁第三方所享有的權利是不穩定的，在實踐中也容易成為各方爭議的焦點。
