    Abstract: 近年來,美容醫學的醫療糾紛與醫療事故不斷增加,且違法的美醫廣告與行銷亦層出不窮。由於「非治療性美容醫學」是針對身體狀況健康的民眾施行,目的是為了滿足民眾個人主觀上對於美的追求或期待,與一般醫療行為之目的有著相當明顯的差異。而且美容醫學在商業化的操作之下,會去鼓動、吸引原本身體健康狀況良好的民眾來接受美容醫學處置,極容易讓原本並無健康或安全風險的民眾,反而因此增加自己健康或安全上的風險。為了深入探討目前美容醫學的相關問題與社會實況,本文採取美容醫學診所就醫經驗的深度訪談法及參與觀察法,並根據實證研究發現及法學解釋方法指出,「非治療性美容醫學」依其性質與法律規範目的,應有消費者保護法之適用。
    In recent years, aesthetic practices have grown in prevalence in Taiwan, but the frequent adverse incidents relating to aesthetic procedures provided by beauty service providers have captured public attention. Though the Ministry of Health and Welfare has attempted to tighten the regulatory framework for aesthetic practices, many commentators argue that it is inadequate. Adopting a socio-legal approach, this study uses in-depth interviews and participant observation to have a firm grasp of what the problems of aesthetic procedures are. Based on the findings of the empirical research, the authors argue that aesthetic medicine should be regulated by Consumer Protection Act to ensure patient safety and the quality of cosmetic operations.
