    Abstract: 歐洲單一市場的理想就是要打破國界，讓貨物、人員、服及資本在其內完全自由流通。其中，要實踐「貨物自由流通」，必須克服關稅、非關稅及稅制等三項障礙。本文的目的是欲探討歐體在排除「非關稅障礙」上的努力，了解其中的思維推理，期對歐洲單一市場內「貨物自由流通」的運作有更清楚的認識。整個實踐過程涉及了執委會、歐體法院、會員國政府、各國司法機關及企業界的歐體法律架構下的互動關係。歐體顯然是將「歧視性非關稅障礙」和「非歧視性非關稅障礙」截然分開，二者屬性各異；另外，「貨物自由流通」是原則，但其適用非漫無邊際，其各項限制亦值得推敲。
