    摘要: 如何描繪法律在日常生活或糾紛/衝突中所扮演的角色?本文提出一個法意識(legal consciousness)理論的文化模型,從「關係自我」(relational self)的情感衡平活動,探索由三個層次構成的集體法意識:事實建構、合法正當性(legitimacy)、公共性(publicity)。在最基礎的「點」,個體尋求合情合理的敘事,讓自我在其中占據較好的道德位置,此種「情」的事實建構形成了人與法律聯繫的根源;許多「點」累積為「線」,雙方在衝突過程各自追求自我認同(identity),找到自我在「權威」關係中的恰當地位,從中建構法律的合法正當性;在較大層次的「面」,社會集體透過參與而確認自我與他人連結上合宜的屬人模式,此種「公共性」的建構同時決定了法律的社會角色。
    This paper explores a model of investigating legal consciousness as a process that is dependent on culturally embedded, emotionally driven concepts that are essential to establishing relationships with others and consequently the law. Based on the concept of the "relational self," this paper proposes a model of relational legal consciousness and advocates for its study to consider the subjective and emotional activities of individuals in their pursuit of self-acceptance and respect within interpersonal relationships and the community. In the socio-cultural context of Taiwan, this model can be described through three levels of emotional balancing activities: point, line, and face. At the point level, individuals construct a reasonable narrative to allow the self to occupy a better moral position while deciding the nature of the event in relation to law; at the line level, disputants seek appropriate identities while challenging their relationship with authority and constructing social acceptance of law`s legitimacy; at the face level, members of society participate in public relations establishing a social recognition mode of the role of law. This paper contributes to the trend in legal consciousness research that depicts it as not constant, organized, or rational but subjective, relational and emotional.
