    Abstract: 一、A屆期非但未返還向B租用之動產,反將其以己有之名義出售交付予善意之C。B向A請求賠償B因此所受損害時,A得否向B主張以A對B已屆清償期之借款與B對A之損害賠償債權互為抵銷?二、C、D因彼此過失之車禍致雙方所有汽車皆有毀損、且皆受有人身損害。C得否主張以彼此間損害賠償債權為抵銷?
