    Title: 淺析違章建築事實上處分權之定位

    Abstract: 在現行民法的架構下,出賣人為履行房屋買賣契約,以使買受人取得房屋所有權,須依第七五八條規定為所有權移轉登記,如未經登記,其所有權移轉行為不生效力。同時,在自己出資建築房屋的情形,得因建築之事實行為而取得房屋所有權,其與依法律行為而取得的情形,尚有所不同,縱使不經登記,亦不在第七五八條所謂非經登記不生效力之列1。至於主管建築機關為便於行政管理,設有須聲請核發建造執照的制度,如未依規定聲請並核發,則於建物完工後,即不得辦理建物第一次所有權登記(俗稱「保存登記」)。
